2. Definitions

• General Terms: Refers to these terms and conditions.
• Application: Any application by Gluceed accessible via specified domains or downloaded from a store.
• Platform: Synonymous with application.
• Challenge: Internal competitions organized within the application.
• Live, Live Board, or Live Score: Virtual space for real-time score tracking and sharing, potentially linked to an Arena.
• Result: Rankings or outcomes recorded within the application.
• Arena: Virtual space grouping users for organizing challenges.
• Organization: Entity managing communication and partnerships with Arenas.
• Administrator: Users managing Arenas or the application.
• Member: Registered user; may also be called a player.
• Visitor: Non-registered user.
• User: Any person using the application, either as a visitor or a member.

3. Acceptance of Terms

By using or registering with the application, users accept these terms without reservation. If users do not agree, they must refrain from accessing the services.

4. Validity of Terms

If any clause or article is found to be invalid or unenforceable, it will not affect the validity of the other terms. Non-enforcement of any clause does not constitute a waiver.

5. Modification of Terms

GLUCEED reserves the right to modify these terms at any time. Updated terms are effective from the date of publication. Users will be notified of changes.

6. Access and Availability

6.1 Registration and Access

The application is accessible free of charge to users with internet access. Membership registration is free and requires providing truthful information.

6.2 Account Closure

Users can close their accounts through their profile. GLUCEED may suspend accounts for violating terms without notice.

6.3 Availability

The application may be temporarily unavailable for maintenance or due to force majeure.

6.4 Geographic Limitation

The application is limited to users residing in the European Union.

7. Limitation of Liability

GLUCEED is not liable for direct or indirect damages, including loss of profits, except as explicitly stated in these terms.

8. Privacy Policy and Data Management

8.1 Confidential Data

• Level 1: Critical data (passwords) encrypted and inaccessible to administrators.
• Level 2: Non-public data (emails) accessible to administrators.
• Level 3: Public data (names, results) with limited visibility.

8.2 User Rights

• Access, correction, deletion, and opposition to personal data.
• Actions available in user profiles or via contact forms.
• Complaints can be filed with the CNIL if rights are not respected.

8.3 Data Persistence

The application does not guarantee data retention without loss.

8.4 Application Information

Information provided is for general purposes and not guaranteed free of errors.

8.5 Cookies

Only essential cookies are used. Users can manage preferences via browser settings.

8.6 User Publications

Users are responsible for content they publish and agree not to violate third-party rights. Administrators of Arenas and Organizations act as moderators and must remove content violating laws or third-party interests.

• Providing and improving user experience.
• Managing user accounts and security.
• Offering personalized services and fraud prevention.
• Complying with legal obligations.

8.8 Third-Party Services

We share user data with third parties to provide services:

• Stripe: Payment processing (Privacy Policy).
• Hosting providers: Gandi and Scaleway.

These third parties are contractually bound to confidentiality and data security obligations.

9. Intellectual Property

All content is protected by applicable laws. Unauthorized reproduction is prohibited.

10. Termination

Users may terminate their use of the application by deleting their account. GLUCEED reserves the right to suspend or terminate access without notice for violations of these terms.

11. Governing Law

These terms are governed by the laws of France. Disputes will be subject to the jurisdiction of the courts in Aix-en-Provence.
